Murder charge likely

TORRINGTON -- Probable cause evidence in the case against the Torrington man accused of slaying another Torrington man early Tuesday was expected to be presented to a judge late Wednesday or Thursday, police said.

Clayton Barnes of Torrington will be charged with murder, police said, for allegedly shooting and killing Richard Gaioni, 56, of 1229 Winsted Road, Unit 88.

Though a press release said that Barnes will be arraigned after being released from Hartford Hospital, they did not rule out the possibility of a bed-side or hospital room arraignment under the circumstances.

Barnes, who is listed in critical but stable condition, was taken to the hospital after stabbing himself multiple times in the Paugnut State Forest and remains under 24-hour-a-day surveillance by Torrington Police officers.

Police say Barnes entered the Country Living Condominiums home of Gaioni and 54-year-old Linda Barnes early Tuesday morning and preceded to shoot Gaioni multiple times, fatally wounding him. Barnes was not injured in the incident, police said.

Linda Barnes is the estranged wife of Clayton Barnes. The pair filed for divorce earlier this year and had ceased residing in the same home.

Police said that in May, Gaioni and Linda Barnes moved in together into the condominium, where they had been living since. Gaioni is Linda Barnes' first husband and the two had reunited earlier this year, police said.

Following the shooting, Clayton Barnes allegedly fled in his pick-up truck and was spotted by police on Old Route 8. From there he led police on a pursuit which ended in the Paugnut State Forest, where Clayton Barnes abandoned his truck before fleeing against - this time on foot.

Just before 7 a.m., Clayton Barnes was located, suffering from the knife wounds, police said.

"When we got to him [Clayton Barnes] he was very shocked at that point," Lt. Chris Smedick of the Torrington Police Department said Wednesday of Clayton Barnes' condition.

Smedick declined to say whether Clayton Barnes was under the influence of alcohol or drugs at the time, calling anything he could say 'speculation.'

Police were able to retrieve a weapon, which is being reviewed by the State forensics laboratory to determine if it used in the murder, Smedick said.

The State Police Western District Major Crime Van was at Torrington Police headquarters on Wednesday, processing Clayton Barnes' pick-up truck, police said.

An autopsy was also performed on Wednesday and results are expected in the next few days.

In the meantime, Torrington Police from the Investigative Services Section continue to work with the CSP Major Crime Squad to pull together forensic evidence, interview possible witnesses and those close to the parties involved and build a case against the accused Clayton Barnes, Smedick said.
