Tentative jury trial dates have been set back in the civil cases involving Barron County, former administrator Duane Hebert and former highway department employees Brian Mattison and Gene Anderson.
In an Oct. 15 letter, Judge Eugene Harrington informed the attorneys representing each side of the dispute that the previously scheduled jury trial component of their proceedings was going to be delayed. The move allows the court more time for handing the "complicated nature" of motions filed in the civil matters. Depending on how the judge rules on these motions, a jury trial ultimately may or may not be used. That decision is expected by mid-November.
The newly crafted schedule includes a Dec. 10 motion hearing date. After that hearing has been held, dates for the jury trials could be re-established. Before this development, jury trials had been tentatively set to take place in November and December.
At the center of the litigation is a disagreement on how Barron County and its former administrator handled an investigation into the highway department. Amidst allegations of misdeeds at the highway department, Mattison and Anderson left behind their highway commissioner and patrol supervisor jobs, respectively. The former employees later filed civil cases against the county and Hebert, citing their own allegations of misrepresentation, breach of contract and more.
