In Woodbury Zoners Seek Withdrawal
of Public Works Proposal

WOODBURY - Zoning Commission Chairman Martin Overton, at a Tuesday, May 26 meeting, recommended the withdrawal of the town's application for screening at the town garage.

Rich Lamonte of the Public Works Department agreed to withdraw the application for a permit to use and operate a screener at 82 White Deer Rocks Rd.

According to Mr. Overton, screening is not allowed in the zone where the town garage is located.

Zoning Enforcement Officer Joe Chapman told Voices that the area is zoned as an open space residential district and screening is not allowed.

Mr. Overton said the Zoning Commission cannot take action on the application.

"There's nothing we can do about it," he said. "If the following uses are prohibited, there's nothing we can do."

Commissioner Bob Clarke said one solution is to truck the materials in need of screening to another location.

Mr. Overton said storing the materials is a legitimate part of Public Works operations. Processing the material, however, becomes problematic, he said.

Mr. Lamonte asked if the town can even operate a Public Works facility at that location, given the limitations. He wondered if a possible solution is to apply for a zone change.

Commissioners approved a timber permit application from Rod Burgess. The property consists of a vacant lot on Pomperaug Road.

Commissioners authorized the zoning enforcement officer to issue a special permit for a fair at St. Paul's Church, taking place on Saturday, June 27.

Regarding land use regulation revisions, Mr. Overton said he was approached by someone who wants to put a wind turbine in town.

He asked commissioner Mr. Clarke to draft a regulation on structures such as wind turbines. Mr. Clarke said he is already working on it.

Lastly, Mr. Overton asked for a zoning enforcement officer report on Ray Hardisty's property at 200 Minortown Rd.

Resident Cliff Atkin attended the April 28 Zoning Commission meeting and inquired about earth material operation on Mr. Hardisty's property.

At that meeting, Mr. Overton said the commission is not an enforcement agency and suggested Mr. Atkin contact the land use office.

Mr. Atkin said he did contact the land use office and ZEO Mr. Chapman visited the property.

The Zoning Commission reconvened as the Woodbury Aquifer Protection Agency, and passed a motion to postpone all WAPA meetings until Tuesday, September 8.

Former town planner Chris Wood, now a consultant for the town, said the Zoning Commission, per state statute, had to adopt a new aquifer protection district zoning map by March 18, and adopt regulations from the state on activities in the area.

Mr. Overton wants members of the public to have a chance to view the maps and make any comments. He said the commissioners asked for a list of property owners who would be impacted by a change in regulations.

Mr. Overton is hoping the postponement of WAPA meetings will allow Mr. Wood time to get information to the commissioners.

Because state statutes required that the map be changed, the commission had no jurisdiction over the maps.

Mr. Overton has stressed in the past that whenever a map is changed, a public hearing takes place and he did not want to deviate from that pattern.

The next Zoning Commission meeting is 7:30 p.m. Tuesday, June 9, at the Annex.
