Margera, who turned 27 in September, appeared before Common Pleas Court Judge Paula Francisco Ott dressed in black boots splattered with white paint, a black suit coat and black pants. As he waited to take the stand, he held the hand of his fiancee, Missy Rothstein.
The star of MTV's "Viva La Bam" and "Jackass" testified that Rivell, 33, climbed the wall surrounding his residence, entered the back door and kicked in a bedroom door on Oct. 17.
"It was about 3:30 in the morning. I have a 10-foot fence with a gate card. She climbed over the fence and broke through the back door," he said.
Margera, who has made a career doing fearless stunts and wild pranks, said that he wants the PFA because he is terrified of what Rivell is capable of.
"I'm really scared. I don't know what she'll do next," he said.
Margera described Rivell as an ex-girlfriend, and he said their relationship ended about two years ago. He also said that they have had a lot of problems in the past.
"About a year before the October incident, it was about 4 a.m. ... She hopped over the fence and kicked the door open," he said. "She yelled at me and said I shouldn't have broken up with her," he said.
The breakup, according to Margera, was anything but pleasant. He said that when they broke up, he was flying from Los Angeles to Brazil, and she vandalized his house and damaged some of his possessions.
"When we broke up, she destroyed $20,000 worth of computers. She put murals around my house," he said. "It was really scary."
He also claimed during testimony that she abused him in the past.
"There's been some times where the police came over my house at one o'clock. We were angry," he said. "She pushed me off of the four-foot balcony where the pool was. I thought she was going to help me, but she threw a glass at me," he said.
Despite Margera's testimony, Ott did not grant him the PFA that afternoon.
"You are giving me speculative information. This is all hearsay," Ott told Margera and his attorney, Eugene J. Malady.
Malady claimed that Rivell is dangerous.
"He knows she associates herself with people who have guns and do drugs," Malady said.
Rivell and Margera split in April 2005 after seven years together. She claims that Margera slept with pop princess Jessica Simpson. Margera originally denied that he ever slept with her, but then he admitted in September that he and Simpson were "intimate."
Malady said after the hearing that he made a settlement with Rivell, and she agreed to an order preventing her from returning to the residence.
The growing conflict between Margera and Rivell only adds to the tumultuous year the celebrity has had.
On Aug. 18, his uncle, Vincent Margera, nicknamed "Don Vito," was arrested at Colorado Mills Mall in Lakewood, Colo., for allegedly groping two underage girls. Vito made several appearances on "Viva La Bam."
