State Police Explain Cell Phone Law

MIDDLETOWN - The Connecticut State Police continue to educate the people of Connecticut regarding the law banning the use of hand-held mobile cell phones while driving in Connecticut.

This law has been in effect in the State of Connecticut since October l. During the first 31 days of October Connecticut State Troopers have stopped numerous motorists who were in violation of this law.

Many motorists were unaware of the elements and requirements of this new law.

Connecticut is the third state to enact this type of legislation, where motorists are banned from the utilization of hand held cell phones while driving.

The only legal way for a motorist to use a cell phone is with the utilization of hand-free devices.

The use of hand-held cell phones while driving is a primary offense in Connecticut; this means that a trooper can stop a motorist for just that specific violation.

During the first month of this law being in effect, the Connecticut State Police have issued a total of 26 tickets to motorists and 51 written warnings.

In addition, state troopers have issued numerous verbal warnings to motorists in an effort to clarify or explain any misconceptions about the cell phone ban law.

If a violator is issued a ticket he/she may, for one time only, show the court proof of purchase of the hand-free device and the charge may be dismissed.

The police wish to issue a reminder that this law also prohibits anyone under the age of 18 years of age from using any mobile phones or mobile electronic devices while a car is moving.

In addition this law also allows police to impose an additional $100 fine to various moving violations such as speeding, tailgating and reckless driving, if the trooper believes the use of hand-held cell phone or other behavior contributed to the poor driving.

The State Police are continuing to be observant of all motorists operating in the state of Connecticut. It is hoped the continued education of motorists regarding this cell phone law will eventually lead to voluntary compliance by all people who drive in our state.
