Driver and Trucking Companies Sued Over Crash

PITTSBURGH - Attorneys for a Pittsburgh-area man filed suit Tuesday in the Allegheny County Court against two Indiana County companies and a truck driver in connection with a fiery crash that injured a motorcyclist two months ago on Forbes Avenue in Pittsburgh.
Mark McGreevy, 44, lost his right leg and was burned on much of his body after a dump truck driven by Jack Fatta Jr. ran over McGreevy's motorcycle on June 3.

In addition to Fatta, the suit names as defendants Taylor Services Inc. and Clarksburg Trucking Inc., the companies that own the truck and employ Fatta.

The suit demands unspecified damages for McGreevy's current and future medical expenses and economic losses and compensation for "substantial bodily disfigurement."

"He has a long road ahead of him," McGreevy's attorney, John Gismondi of Pittsburgh, said Wednesday. "He is still in the burn unit and has had four or five skin graft surgeries."

Gismondi, of the law firm Gismondi & Associates, charges in the suit that Fatta drove behind McGreevy for several minutes before both vehicles came to a stop on Forbes Avenue. Then, Fatta drove the truck over the back of McGreevy's motorcycle "in reckless and conscious disregard for (McGreevy's) well-being," according to the suit.

A criminal investigation of the accident by Pittsburgh police is incomplete, Gismondi said.

Jeff Taylor, the owner of Taylor Leasing of Blairsville, acknowledged that the suit had been filed against his companies but he declined to comment on the suit, referring questions to his attorney, Chester Dudzinski of Pittsburgh. Dudzinski did not return a call seeking comment.

McGreevy's lawsuit asks a jury to find Taylor Services and Clarksburg Trucking liable for Fatta's driving. It alleges that the companies were negligent for failing to keep the truck in running order and failing to investigate Fatta's background and driving record before hiring him.

At the Allegheny County courts' present pace, a resolution of the suit could be 18 months away, according to Gismondi.
