This project used $103,118 in federal funds to assist in faade improvements to several businesses in the Village of Port Austin under Title I of the Housing and Community Development Act of 1974 (P.L. 93-383).This closeout hearing is available to present any details of the completed MSHDA CDBG project and the public is invited to attend. The hearing will be held on February 16, 2010 at 9:00 a.m. in the Huron County EDC Office, 250 E. Huron Ave. #303, Bad Axe, MI 48413.

A special meeting of the Bad Axe City Council was called to order at 7:30 p.m. on Monday, January 25, 2010 by Mayor Jim Hicks for the purpose of appointing an acting city manager.ROLL CALL:Present: Mayor Jim Hicks; Council members: Cleland, Hall, Particka, Peterson, Rochefort and Rapson. Other Officers present: Clerk Goebel.Absent: City Manager Nugent.ORDER OF BUSINESSCouncil member Rapson gave the council an overview of the candidates interviewed at the committee meeting on Saturday, January 23, 2010. The two candidates interviewed were Dale VanDeVusse and Tom Booms. He stated that the committee recommends Dale VanDeVusse.Council members Cleland and Rochefort both questioned the need to hire during the interim period, council member Rapson expressed that it was the best interest of the city to have an additional staff member.Motion by Rapson, second by Hall to offer the acting city manager position to Dale VanDeVusse subject to an agreement drawn up by City Attorney, John Ferris.AYES: Hall, Particka, Peterson, Rapson, Hicks.NO: Cleland, Rochefort.Motion by Hall, second by Cleland to contact the Michigan Municipal League for the purpose of assisting the city in establishing criteria for a selecting a city manager, assistance with the advertising and interviewing.AYES: Cleland, Peterson, Particka, Hall, Rapson, Rochefort, Hall.NO: None.ADJOURNMENTMotion by Cleland, second by Particka to adjourn at 7:42 p.m. Voice vote: all voting aye, motion carried.Jim Hicks, MayorKay M. A regular meeting of the Bad Axe City Council was called to order at 7:30 p.m. on Tuesday, January 19, 2010 by Mayor Jim Hicks.ROLL CALL:Present: Mayor Jim Hicks; Council members: Cleland, Hall, Particka, Peterson, Rochefort and Rapson. Other Officers present: Clerk Goebel.Absent: City Manager Nugent.APPROVAL OF MINUTESMotion by Rapson, second by Hall to approve the minutes from January 4, 2010. Voice vote: all voting aye, motion carried.PUBLIC COMMENTMr. and Mrs. Patrick Delacourt, 1038 E. Hopson St. and Phil Peyerk from Phils Plumbing & Heating who performed services for the Delacourts addressed council regarding a sewer replacement at their residence.Council members stated that they needed time to research what occurred and Mayor Hicks requested the citys Department of Public Work Supervisor attend the next council meeting.ORDER OF BUSINESS1. Motion by Cleland, second by Particka to appoint Don McKimmy to the Board of Review for a three year term expiring January 31, 2013. Voice vote: all voting aye, motion carried.2. Motion by Cleland, second by Particka to appoint Vern Seibert to the Bad Axe Area Fire Protection Association Board for a six year term expiring December 31, 2015. Voice vote: all voting aye, motion carried.3. Motion by Hall, second by Rapson to pay the bills totaling $144,046.71.AYES: Hall, Rochefort, Rapson, Particka, Hicks, Peterson, Cleland.NO: None.4. A special meeting of the Bad Axe City Council was called to order at 7:30 p.m. on Thursday, January 14, 2010 by Mayor Jim Hicks to review the City Managers contract.ROLL CALL:Present: Mayor Jim Hicks; Council members: Hall, Particka, Peterson, Rochefort and Rapson. Other Officers present: City Manager Nugent, Clerk Goebel and City Attorney John Ferris. Absent: Cleland.PUBLIC COMMENTNone.ORDER OF BUSINESSCity Attorney John Ferris stated that he was aware of the meeting which had been scheduled (referring to the special meeting of January 14, 2010) and had an opportunity to speak with the City Manager and requested John Nugent to address the council. John Nugent stated that pending council approval he has accepted the separation agreement and stated that his last day of work would be January 31, 2010. John Ferris then stated that it was his understanding that John Nugent was retiring and Mr. Nugent confirmed that he would be retiring. John Ferris then outlined the following items from the separation agreement and recommended to council that they accept:* Entitled to accumulated sick time 484 hours totaling $15,589.64* Entitled to accumulated vacation time totaling $2,254.70* Entitled to severance pay pursuant to his prior contract 480 hours totaling $15,460.80* For a total amount of $33,305.14Mayor Cleland arrived at 7:34 p.m.John Ferris indicated that he will draft a separation agreement which contains a hold harmless and general release clause, and that Mr. Nugent agrees to be available on an as needed basis for the city to advise or address concerns on city matters. City Attorney John Ferris recommended a motion to accept the terms of the separation agreement.Motion by Hall, second by Rapson to accept the retirement of John Nugent, with the severance terms as outlined by City Attorney John Ferris, thank him for his years of service to the City of Bad Axe and the excellent condition the city is in under his supervision.AYES: Hall, Particka, Peterson, Rapson, Rochefort, Hicks.NO: Cleland.Council member Cleland adamantly opposed the motion and stated he felt council violated the citys charter. He stated that he would be researching misconduct in office charges and seek possible language for a recall petition. He thanked John Nugent for everything that he has done for the City and expressed how angry he was over councils action .I really have to think long and hard on how long I would want to serve for a kangaroo court! You gentlemen- Nick you excluded, as I look over here are pathetic excuses of leadership for the City.MAYOR AND COUNCIL COMMENTSCity Manager Nugent thanked members of council that supported him, the employees, and John Ferris for his guidance and legal expertise and expressed that he has a great affection for the City of Bad Axe.ADJOURNMENTMotion by Peterson, second by Particka to adjourn at 7:39 p.m. Voice vote: all voting aye, motion carried.Jim Hicks, MayorKay M.
